Little Rock Look Back: Suit filed calling for integration of LR public facilities

On March 8, 1962, 22 members of the Council on Community Affairs filed a lawsuit in U.S. District Court against the city Board of Directors for the desegregation of “public parks, recreational facilities, Joseph T. Robinson Auditorium and all other public facilities.”  The members included journalists, dentists, attorneys, school teachers and other members of Little Rock’s African American professional class.  Attorney Wiley Branton, Sr., filed the suit.

Though the City’s Auditorium Commission was mentioned in the suit, they were not served with papers. So when media contacted them, they made no comment.

Historian John A. Kirk has written, “Members of the City Board were willing to admit that the desegregation of public facilities was ‘a foregone conclusion’ if the case went to court, but they remained committed to fighting the lawsuit if only to buy time to devise other methods to avoid desegregation.”

The decision was rendered in February 1963 that the City must integrate its public facilities.

In 1951, the City’s library facilities had been integrated followed by the bus system in 1956. Both of these had been accomplished without incident.  Of course the same was not said for the integration of the public schools in 1957.

In 1961, there had been attempts to have Robinson Auditorium integrated after Duke Ellington threatened to cancel a concert rather than play to a segregated crowd.  The Auditorium Commission refused to change its policy, and Ellington did not play the concert.

Based on efforts of the Council of Community Affairs working with white business leaders, downtown lunch counters and businesses were integrated starting in January 1963.  The efforts of the Council of Community Affairs and the white business leaders are commemorated in the Arkansas Civil Rights Heritage Trail with medallions in front of the Little Rock Regional Chamber building.

LR Women Making History – Ellen Turner Carpenter

Ellen Turner Carpenter was born on July 30, 1916 on West Ninth Street.  At the time of her death at the age of 93, her life had come full circle.

As a young girl, she was an active participant in the thriving African American life along west Ninth Street in downtown Little Rock. She attended many events at the Mosaic Templars Hall which sat at Ninth and Broadway.

A longtime Little Rock educator, she became the moving force behind preserving the Mosaic Templars building in the 1980s.   In 1992, she became president of the Mosaic Templars Building Preservation Society, which worked to preserve the Mosaic Templars building in Little Rock to create a museum for black history in Arkansas. Mrs. Carpenter served as president of the society until her death.

In the 1990s, the City of Little Rock purchased the building to keep it stable while the Preservation Society sought to raise the funds.  Due to lobbying efforts led by Mrs. Carpenter, the State of Arkansas purchased the building from the City with the intention of turning it into a museum under the auspices of the Department of Arkansas Heritage.  At a ceremony in 2003, Vice Mayor Willie Hinton handed the keys of the building to Governor Mike Huckabee with Mrs. Carpenter nearby beaming.  Governor Huckabee appointed her to the state advisory committee for this new museum.  She would serve as chair of that committee.

On March 16, 2005, tragedy struck.  The building burned to the ground.  That afternoon at a press conference at the State Capitol, leaders expressed their resolve that the project would move forward with a new building following the original design.  One of the speakers that afternoon was Mrs. Carpenter. She started out in her usual quiet voice. But as she recalled her youth spent at the Mosaic Templar’s building, the years melted away. She demonstrated some of the step dancing she had done as a teenager.

On September 20, 2008, she presided over the grand opening of the new Mosaic Templars Cultural Center. It was the culmination of 15 years of official work and many more years of dreaming.  At the ceremonies, she declared “We made it!” “We made it! We made it!”

Mrs. Carpenter remained an active supporter of the MTCC until her death on July 27, 2010, just three days shy of her 94th birthday.

Throughout her life she wore many hats (including numerous ones to church on Sunday). She was an educator, neighborhood organizer, and public servant. Everyone who met her was positively impacted by her.  Due to her vision and endurance, thousands each year are still positively impacted by her when they visit the Mosaic Templars Cultural Center.  Fittingly, the conference room at MTCC is named in her memory.

Little Rock Look Back: Sen. William Marmaduke Kavanaugh

On March 3, 1866, William Marmaduke Kavanaugh was born in Alabama. He later moved with his family to Kentucky before coming to Little Rock as a newspaper reporter.

Kavanaugh served as editor and manager of the Arkansas Gazette before entering politics.  From 1896 until 1900, he served as Pulaski County Sheriff, which at the time also included the duties of tax collector.  From 1900 until 1904, he was County Judge of Pulaski County.  In that capacity he helped wrangle several cities, railroads and trolley lines to create a compromise which lead to the completion of the Third Street Viaduct which connected Little Rock with Pulaski Heights. It is still in use today.

After leaving his post as County Judge, he had a varied career in banking and business interests.

When Senator Jeff Davis died in early January 1913, he left the last few weeks of his term incomplete as well as the new term he was set to start in March 1913.  There was much interest in who would fill the remainder of Davis’ current term, because that person might be the frontrunner to also fill out the new term.  (This was at the time that the U.S. Senators were still selected by state legislatures.) Defeated Governor George Donaghey appointed J. N. Heiskell to fill out the term. But once the Arkansas General Assembly convened in mid-January, they overrode Donaghey’s appointment and replaced Heiskell with Kavanaugh.

Kavanaugh served in the Senate from January 29, 1913 until March 3, 1913.  He was succeeded by Joseph T. Robinson who had only recently taken office as Governor.  Speculation was that Kavanaugh would not want the full six year term, so that he was acceptable choice to all of the politicians jockeying for the full appointment.  From 1912 until 1915, he was an Arkansas member of the Democratic National Committee.

Another interest of Kavanaugh’s was baseball.  He served as president of the Southern Association minor league starting in 1903.  The baseball field in Little Rock situated at West End Park was named Kavanaugh Field in his honor.  It stood until the 1930s when it was replaced by what is now known as Quigley Stadium.  (In 1927, Little Rock High School had opened on the land which had been West End Park.)

Kavanaugh died on February 2, 1915 at the age of 48.  He is buried in Oakland Cemetery.

Prospect Road was renamed Kavanaugh Boulevard in his memory.

LR Women Making History: Dr. Sybil Jordan Hampton

Dr. Sybil Jordan Hampton made history as the first African American student to attend each high school year at and graduate from Little Rock Central High School.  But her impact on history exceeds that and extends into classrooms throughout Arkansas.

After a career which took her from elementary classrooms to corporate boardrooms, Dr. Hampton returned to Little Rock in 1996 to become the President of the Winthrop Rockefeller Foundation.  In that capacity, she oversaw many opportunities to broaden the ways the arts and humanities were used in classrooms and outside of classrooms.  Dr. Hampton led the WRF until her retirement in 2006.  Through her vision and leadership, many tens of thousands of dollars of support went to cultural institutions and organizations during her decade at the helm.

Following the untimely death of the Arkansas Symphony Orchestra’s executive director, Dr. Hampton served as acting executive director of the ASO while a national search could be conducted.  She had long been a supporter of the ASO and other cultural institutions as a patron.

During the Central High Integration 60th Anniversary, Dr. Hampton served as emcee of the Commemoration Ceremony.  She continues to be involved with Little Rock’s cultural life through her involvement in the Mount Holly Cemetery Association. She is a tireless advocate for this living museum of Little Rock’s past.

LR Women Making History – Nancy Hall

Nancy Pearl Johnson Hall was married to longtime Arkansas Secretary of State C. G. “Crip” Hall.  Following his death, Mrs. Hall was appointed to succeed him as Secretary of State.  With this appointment, she became the first woman to serve as a Constitutional Officer in Arkansas.  As an appointee to that office, she could not run for it in the following election.

Instead, in 1962, she was elected to be the 33rd Treasurer of the State of Arkansas.  She held that position from January 1963 until January 1981.  Her campaign slogan during each election was “I’ll Take Care of Your Money.” She somewhat reluctantly decided to forego another term and did not run for office in 1980.

When she left office in January 1981, she finished a career working for the state which had started in 1925.   She died on January 1, 1991 and was buried next to her husband.

Little Rock Look Back: US Supreme Court rules in Bates v. City of LR

On February 23, 1960, the U. S. Supreme Court handed down a decision in the case of Daisy BATES et al., Petitioners, v. CITY OF LITTLE ROCK et al.  This case had been argued before the Court in November 1959.

Daisy Bates of Little Rock and Birdie Williams of North Little Rock were the petitioners.  Each had been convicted of violating an identical ordinance of an Arkansas municipality by refusing a demand to furnish city officials with a list of the names of the members of a local branch of the National Association for the Advancement of Colored People. The question for decision was whether these convictions can stand under the Due Process Clause of the Fourteenth Amendment to the United States Constitution.

The Little Rock ordinance (10,638) was passed on October 14, 1957. It charged that certain non-profits were actually functioning as businesses and using non-profit status to skirt the law. Therefore it required the non-profits to disclose their members and sources of dues.  North Little Rock passed an identical ordinance.

(Mayor Woodrow Mann was not present at the meeting of the LR Council when the ordinance was passed. But he signed all of the resolutions and ordinances approved that night.  Ordinance 10,638 was the only legislation that night which had also been signed by Acting Mayor Franklin Loy.  Mayor Mann crossed through Loy’s name and signed his own.)

Mrs. Bates and Mrs. Williams as keepers of the records for their respective chapters of the NAACP refused to comply with the law.  While they provided most of the information requested, they contended they did not have to provide the membership rosters and dues paid.

After refusing upon further demand to submit the names of the members of her organization, each was tried, convicted, and fined for a violation of the ordinance of her respective municipality. At the Bates trial evidence was offered to show that many former members of the local organization had declined to renew their membership because of the existence of the ordinance in question. Similar evidence was received in the Williams trial, as well as evidence that those who had been publicly identified in the community as members of the National Association for the Advancement of Colored People had been subjected to harassment and threats of bodily harm.

Each woman was convicted in the court of Pulaski Circuit Court, First Division, William J. KirbyJudge. They were fined $25 a person.  On appeal the cases were consolidated in the Supreme Court of Arkansas in 1958. The convictions were upheld by five justices with George Rose Smith and J. Seaborn Holt dissenting.

Mrs. Bates and Mrs. Williams then appealed to the U. S. Supreme Court.  The pair’s legal team included Robert L. Carter and George Howard, Jr. (who would later become a federal judge).  Little Rock City Attorney Joseph Kemp argued the case for the City.  The arguments before the U. S. Supreme Court were heard on November 18, 1959.

The SCOTUS decision was written by Associate Justice Potter Stewart.  He was joined by Chief Justice Earl Warren and Associate Justices Felix Frankfurter, Tom C. Clark, John M. Harlan II, William J. Brennan and Charles E. Whittaker.  Justices Hugo Black and William O. Douglas wrote a concurring opinion.

The U. S. Supreme Court reversed the lower courts.

In sum, there is a complete failure in this record to show (1) that the organizations were engaged in any occupation for which a license would be required, even if the occupation were conducted for a profit; (2) that the cities have ever asserted a claim against the organizations for payment of an occupation license tax; (3) that the organizations have ever asserted exemption from a tax imposed by the municipalities, either because of their alleged nonprofit character or for any other reason.

We conclude that the municipalities have failed to demonstrate a controlling justification for the deterrence of free association which compulsory disclosure of the membership lists would cause. The petitioners cannot be punished for refusing to produce information which the municipalities could not constitutionally require. The judgments cannot stand.

In their concurring opinion, Justices Black and Douglas wrote that they felt the facts not only violated freedom of speech and assembly from the First Amendment, but also aspects of the Fourteenth Amendment. They wrote that the freedom of assembly (including freedom of association) was a principle to be applied “to all people under our Constitution irrespective of their race, color, politics, or religion. That is, for us, the essence of the present opinion of the Court.”

Neither the Gazette or Democrat carried any reaction from City leaders. There was a City Board meeting the evening of the decision. If it was mentioned, the minutes from the meeting do not reflect it.

Arkansas Attorney General Bruce Bennett, on the other hand, was very vocal in his outrage. The city laws were known as Bennett Laws because they had been drafted by him as ways to intimidate African Americans and others he viewed as agitators.

In 1960 Bennett was challenging Governor Orval Faubus for the Democratic gubernatorial nomination.  In reaction to the to the Supreme Court he vowed that, if elected Governor, he would “de-integrate” (a term he proudly took credit for coining) the state.

For his part, and not to be outdone by the AG, Faubus fretted that the Court’s decision meant that Communists would be able to give money to the NAACP.

Little Rock Look Back: Museum of Discovery opens in River Market

Founded in 1927 as the Arkansas Museum of Natural History and Antiquities in a downtown storefront, by 1997, the museum had been located in at least two other spots and had several different names.  On February 21, 1998, it reopened as the Museum of Discovery in its new location in the recently launched River Market district.  It occupied space on the first floor and basement of the Museum Center building (formerly the Terminal building the erstwhile train station which later was used for printing the Arkansas Democrat.)

The new name and new space reflected a greater emphasis on the science aspect of the museum’s mission.  It featured many hands on and interactive exhibits.

The museum spent one-third of its $10.6 million cost on exhibits.  Of the $10.2 million pledged for the museum, 47 percent — or about $4 million — came from a half-cent city sales tax approved by voters about five years ago. Another 14 percent came from foundations and 2 percent from private organizations and individuals. The remaining 37 percent came from corporations, sometimes in connection with specific exhibits.

Following a February 20, 1998, preview party, the official grand opening was held on February 21, 1998.

The previous museum space (inside the Arsenal building in MacArthur Park) occupied 14,000 square feet, 8,000 of which was display space. After the move, the museum had 35,000 square feet of display space.
